Terms and conditions

1 About these terms

wearclayandchalk.com is operated by Clay and Chalk LLC, a Wyoming limited liability company doing business as Clay and Chalk (we, us, or our). Its registered agent address for legal and official notices only is 30 N Gould St Ste N, Sheridan, WY 82801, United States. These terms govern use of our website and purchases made directly through it. Our Shipping Policy and Return and Refund Policy form part of the purchase terms. Our Privacy Policy explains personal-information and tracking practices.

By placing an order after being given access to these terms, you agree to the purchase terms. Website-use provisions apply to your use to the extent enforceable under applicable law. Accepting these terms does not constitute consent to optional cookies or marketing subscriptions. Mandatory consumer law prevails over conflicting provisions.

The purchase terms and policies displayed when you place your order apply to that purchase. A product-specific shipment schedule or restriction clearly disclosed before purchase applies to that product, subject to applicable law.

2 Eligibility and account security

You must be legally able to enter into a purchase contract where you live, or purchase through a parent or guardian authorized to enter into the transaction. You must be authorized to use the payment method supplied. Provide accurate account, contact, billing, and delivery information. Keep account credentials secure and notify us promptly of suspected unauthorized access. Responsibility for unauthorized activity remains subject to applicable law.

3 Products and descriptions

We aim to describe products accurately. Screen settings may affect displayed colors. Refer to product pages for composition, dimensions, fit, care, and specific performance claims. Minor display differences do not remove your rights if an item materially differs from its description. Products are subject to availability; placing an item in your cart does not reserve it.

4 Prices payment and taxes

Prices are in US dollars. Applicable tax and shipping appear at checkout before you place your order. Standard shipping is $5 when the merchandise subtotal after discounts is below $75, and free at $75 or more, before tax and shipping. Expedited services, if offered, are charged separately.

Available payment methods are shown at checkout. You authorize the total displayed for your order. Payment authorization and capture follow the selected payment method and our checkout configuration. If payment cannot be completed, we may be unable to fulfill the order.

Prices may change for future purchases. A later price change does not alter an accepted order. If a material price or product-information error is identified before acceptance, we contact you to confirm corrected details or cancel the affected items and promptly refund captured payment. We do not charge a higher price without your agreement.

5 Order acceptance and cancellations

Your order is an offer to buy the items listed at checkout. The initial acknowledgment confirms receipt and does not by itself constitute acceptance. We accept the relevant items when we send shipment confirmation. For partial shipments, acceptance applies to the items confirmed as shipped.

Before acceptance, we may refuse or limit an order for unavailable inventory, a material error, suspected fraud, unauthorized resale, payment failure, or an unsupported address. We notify you and promptly refund captured payment for canceled items. This process does not remove our obligations concerning stated shipment periods, delay notices, or refunds.

6 Shipping returns and product issues

Our Shipping Policy governs delivery coverage, charges, estimates, tracking, changes, and delays. Our Return and Refund Policy provides free eligible returns requested within 30 days of delivery, subject to its conditions. Eligible customers may request a direct exchange for another size or color of the same style. The first eligible exchange includes standard replacement shipping; exchanges are sent after the returned item is received and inspected, subject to availability. Original outbound shipping fees are generally excluded from preference refunds; legal exceptions remain protected.

We remain responsible for legally required remedies for undelivered, incorrect, damaged, faulty, or misdescribed goods. Carrier disruptions or circumstances outside our reasonable control do not eliminate applicable cancellation, refund, or product-remedy rights. Any separately offered written warranty will be identified with its terms before purchase; no lifetime warranty is created by these terms.

7 Offers and gift cards

Any offer applies only under the conditions disclosed before purchase and cannot be applied retrospectively unless expressly stated. We may decline an offer obtained through fraud or misuse, subject to applicable law. Gift cards, if offered, are subject to their separately disclosed terms and applicable laws; these terms do not impose an undisclosed expiry date or fee.

8 Lawful website use

Use the website lawfully. Do not bypass security, access another person's account without authorization, submit fraudulent orders, introduce malicious software, overload the service, or infringe intellectual property rights. We may reasonably restrict access to address unlawful activity, fraud, or security threats. Restrictions do not remove rights attached to valid purchases.

9 Intellectual property

Brand elements, designs, images, text, and other website content belong to us or our licensors and are protected by applicable law. You may view the website and share links for personal use. Commercial copying or exploitation requires permission except where the law allows otherwise. Buying a product does not transfer rights in our brand or designs.

10 Reviews and submitted content

If a review feature is available and you submit a review, you retain ownership and grant us a nonexclusive license to display and format it within that feature. Do not submit unlawful material, private information about others, or content you have no right to provide. We may moderate violations but do not prohibit honest negative reviews. Advertising use of your name, image, or review outside that feature requires separate permission.

11 Privacy and communications

Our Privacy Policy explains how we handle personal information and tracking practices. Transactional communications may be necessary to manage your order. A purchase does not automatically subscribe you to promotional email or SMS. Optional subscriptions use separate consent and unsubscribe mechanisms. SMS programs, subscriptions, contests, or loyalty programs require separate terms if introduced.

12 Third party services and availability

Shopify hosts our store. Payment processors, carriers, and other providers may have additional terms applicable to their services, but their involvement does not remove our obligations to you for purchases. Links to external websites do not mean we endorse their content. We take reasonable steps to maintain the website but do not guarantee uninterrupted or error-free access.

13 Liability and protected rights

To the extent permitted by applicable law, neither party is responsible for indirect or consequential losses that were not reasonably foreseeable when the purchase contract was made. Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or other liability that cannot lawfully be excluded or limited.

These terms do not disclaim protected implied warranties, exclude required refunds or product remedies, or override a separately offered written warranty. If your jurisdiction does not permit a limitation, it applies only to the extent permitted there.

14 Disputes and governing law

Contact hello@wearclayandchalk.com about a concern so we can try to resolve it. Contacting support is not a mandatory prerequisite to a legal remedy and does not shorten a legal deadline. These terms do not require arbitration or waive class-action rights.

These terms are governed by the laws of Wyoming, without excluding mandatory protections applicable to you. Legal proceedings must be brought before a court with lawful jurisdiction. No exclusive court location is designated.

15 Changes and general provisions

We may update these terms for future use and purchases by posting an effective date and providing any notice or agreement required by law. Changes do not reduce rights attached to earlier purchases. If a provision is unenforceable, the remaining terms apply to the extent permitted by law. A failure to enforce a provision once does not waive future enforcement. These terms and the applicable purchase policies govern the purchase without displacing mandatory legal rights.
